1. Acceptance of the Terms

By accessing or using the Questa services (the "Platform"), you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, you may not use the Platform.

If you use the Platform on behalf of an organization, you represent that you have the legal authority to bind that organization to these Terms.

2. Who we are

The Questa Platform is a SaaS solution for event gamification. It lets organizations (customers) create challenges, leaderboards and interactive experiences for their participants through mobile and web apps.

3. Eligibility and minimum age

To use the Platform you must be at least 16 years old (or the minimum legal age in your country of residence to consent to the processing of your personal data). Users between 13 and 15 may participate only with verifiable consent from a parent or guardian, managed by the organization running the event.

The Platform is not intended for children under 13. We do not knowingly collect personal data from children under 13. If you become aware of an account created by someone under 13, please contact us immediately at info@questa.pt for deletion.

4. Account and security

You are responsible for keeping your credentials confidential and for all activity that occurs under your account. Notify us immediately if you suspect unauthorized use.

You agree to provide true, current and complete information during registration and to keep that information up to date.

5. Acceptable use

You agree not to:

• Use the Platform for illegal, fraudulent or harmful purposes
• Upload offensive, defamatory, discriminatory or nudity-containing content, or content that infringes third-party rights
• Attempt to bypass security mechanisms, reverse-engineer or decompile the Platform
• Use bots, scrapers or automated tools without written authorization
• Interfere with the operation of the Platform or disrupt other users' experience
• Collect other users' personal information without their consent
• Distribute viruses, malware or malicious code

We reserve the right to suspend or delete accounts that violate these Terms, without prior notice when necessary to protect the Platform or its users.

6. User content

You are responsible for all content (photos, comments, profiles, challenge submissions) you upload to the Platform ("User Content"). You retain all rights to your User Content.

By uploading User Content you grant Questa and the event-hosting organization a non-exclusive, worldwide, royalty-free, revocable license to use, store, display and distribute that content within the scope of the event and strictly for the purpose of operating the service.

We have no obligation to monitor User Content, but we may remove content that violates these Terms at any time.

7. Intellectual property

All software, design, trademark, logo, source code and Platform materials are the property of Questa or its licensors and are protected by intellectual-property laws in Portugal, the European Union and internationally.

No rights are granted to you over Questa's trademarks, logos or visual identity beyond what is strictly necessary for normal use of the Platform.

8. Subscriptions and payments

Paid Questa plans (per event or annual subscription) are billed via Stripe. Prices, payment terms and refund policy are described on the Pricing page and at the time of purchase.

Annual subscriptions renew automatically unless cancelled before the renewal date. You may cancel at any time through the backoffice; you retain access until the end of the paid period.

9. Account deletion

You may delete your account at any time via your profile in the backoffice or the mobile app. After deletion, your personal data is erased or anonymized within a maximum of 30 days, except where the law requires longer retention (e.g. invoicing).

We may delete or suspend your account in case of violation of these Terms, fraudulent activity, or legal requirement.

10. Availability and warranties

We strive to keep the Platform available 24/7 but do not guarantee uninterrupted availability. Outages may occur due to planned maintenance, technical failures or events beyond our control.

The Platform is provided "as is" and "as available". To the maximum extent permitted by law, Questa disclaims all implied warranties (including merchantability, fitness for a particular purpose, and non-infringement).

11. Limitation of liability

To the maximum extent permitted by law, Questa is not liable for indirect, incidental, special, consequential or punitive damages (including loss of data, loss of profits or loss of business opportunities) arising from the use of or inability to use the Platform.

Questa's total liability, in any circumstance, will not exceed the amount paid by you to Questa during the 12 months preceding the event giving rise to the claim.

12. Indemnification

You agree to indemnify and hold Questa, its directors, employees and partners harmless from any claims, damages or expenses (including legal fees) arising from: (a) your violation of these Terms; (b) User Content you upload; (c) violation of third-party rights.

13. Governing law and venue

These Terms are governed by Portuguese law. Any dispute arising out of or related to these Terms shall be submitted to the exclusive jurisdiction of the courts of Lisbon, without prejudice to the consumer's right to bring proceedings before the courts of their place of residence under applicable legislation.

14. Changes to the Terms

We may update these Terms at any time. When changes are material we will notify you by email or via the Platform at least 30 days in advance. Continued use after the changes take effect constitutes acceptance of the new Terms.
